Med Pulse Terms of Service

These Terms of Service (“Agreement”) apply when you register for or use any Med Pulse services (“Services”). By signing up or accessing our services, you agree to abide by these terms.

1. Agreement Overview

This Agreement, along with any referenced policies, pricing schedules, or supplementary documents, constitutes the entire contract between Med Pulse and you, the customer (“you” or “Customer”), regarding your use of our Services.

2. Definitions

  • Med Pulse (“we,” “us,” “our”) refers to the company providing the Services.
  • Services include any secure, HIPAA-compliant faxing solutions, such as email-to-fax transmission, fax number routing services, and related support.
  • Med Pulse Number refers to the fax number we assign to you for use with our Services.

3. Customer Obligations

You agree to:

  • Provide truthful, accurate, and current contact and billing information, and update us promptly of any changes.
  • Pay for Services at the rates shown on our website or agreed upon in writing. Payments are processed automatically and are exclusive of applicable taxes.
  • Be liable for any collection costs or late fees (e.g., 2% monthly interest).
  • Dispute any charges in writing within seven (7) days of receipt.
  • Not use the Services for illegal purposes. You are responsible for the content of any transmissions. We act as a passive conduit for your communications.
  • Maintain compatible hardware, software, and internet connectivity to send and receive emails and faxes. We are not liable for any incompatibility issues on your end.
  • Comply with the Telephone Consumer Protection Act (TCPA), which prohibits sending unsolicited fax advertisements. We reserve the right to filter or block such transmissions and encourage reporting of any spam faxes.

4. Ownership & Fax Numbers

  • Fax numbers are owned by telecom carriers. Med Pulse assigns them for your use; however, we reserve the right to reassign numbers if required.
  • All intellectual property rights in the Services and related materials remain with Med Pulse or its licensors.

5. Termination & Suspension

  • You may terminate this Agreement at any time by giving us notice in accordance with our verification guidelines.
  • Med Pulse may terminate or suspend your service for breach of terms, non-payment, or at our discretion, with notice (typically seven days) when applicable.
  • Emergency or carrier-related disruptions may also result in temporary service suspension.

6. Refund Policy

  • Cancellation triggers a prorated refund for the remaining full months in your current billing cycle, excluding any applicable usage fees. Refunds are processed within 35 days of cancellation.

7. Disclaimer & Liability

  • Use of the Services is at your own risk. Med Pulse is not liable for indirect, incidental, or consequential damages except in cases of gross negligence or willful misconduct.
  • The maximum liability owed to you is limited to the fees you have paid for the Services.
  • We are not responsible for outages or delivery failures caused by third-party systems beyond our control (e.g., email providers or third-party infrastructure).

8. Notices

  • We may contact you via email, website notices, fax, or postal mail.
  • To effectively terminate the Agreement, you may need to use designated communication channels and complete identity verification steps.

9. Governing Law

This Agreement is governed by the laws of the State of Texas (or another relevant U.S. jurisdiction). Any invalid or unenforceable provisions will be modified or removed while preserving the intent of the remaining terms. Neither party may assign this Agreement without the other’s written consent, except in business restructuring scenarios.
